Adoption visa allows children adopted from outside Australia to live in the country with their adoptive parents. The child can migrate to Australia as a permanent resident. Adoptive children will have access to study and healthcare facilities in Australia. The child should not be above the age of 18 years when adopted. Also they should fulfill the age criteria when they apply and when the department takes a decision on their visa application.

Main Features of Adoption Visa Subclass 102

With an adoption visa the child can:

  • Stay in the country indefinitely with their adaptive parents. The child becomes a permanent resident of the country
  • Work in study in Australia
  • Enroll in Australia’s Public Health Care scheme i.e. Medicare
  • Apply for a citizenship if eligible
  • Travel to and from the country for a period of 5 years.

The child will have access to unrestricted travel to from the country for 5 years. You can also consider getting an Australian citizenship for the child after becoming an Australian citizen the child will not require visa to enter the country. They will just need their Australian passport.

If your child has siblings who also want to apply for an adoption visa then you will need to submit separate applications for each of the siblings.

The cost of the visa is AUD 3,140.00 for the applicant. Some additional charge may apply depending upon individual case.

Adoption Visa Australia Requirements (Eligibility)

If you are a child who has been adopted or is in the process of being adopted, then to be eligible to apply for an adoption visa, you must:

  • Have been or in the process of being adopted through an inter-country adoption between two countries other than Australia.
  • protection of children and cooperation in respect of inter country adoption
  • Have been adopted through an expatriate adoption.

In case of expatriate adoptions, the government of Australia has no rule to play. They will not provide documents that support or endorse expatriate adoptions overseas.

Eligibility criteria for expatriate adoptees

In case of an expatriate adoption, you have to meet the following criteria:

  • At least one adoptive parent must have resided outside Australia for more than 12 months immediately before lodging the visa application
  • The adoptive parent must not have resided overseas to avoid Australia’s inter country adoption laws
  • Parent must have full and permanent parental rights
  • You must have adhered to the laws of adoption of the home country.

In case the child adopted in an overseas country apart from Australia it will not guarantee that the overseas adoption will meet the requirements of an Adoption visa Subclass 102.

Having a sponsor

The child should be sponsored by an eligible adoptive parent.

Age

The child must be under 18 years at the time of adoption. This also applies when they submit the application when the department makes a decision on their application.

Character and health requirements

The child along with any dependent children who apply for the adoption visa 102 must meet the health requirements.

Debts towards Australian government

If the child or any family member owes Australian government some money then it has to be paid back or an arrangement should be made to pay it back.

Interests of the child

The department will not grant the visa if it is not in the best interests of the child.

Documents Required

Documents will include:

  • Evidence that the sponsor is an Australian citizen, permanent resident or an eligible New Zealand citizen.
  • Evidence of sponsors income such as, bank statements, pay slip, tax records
  • Police certificate to ascertain the good character of the adoptive parent.
  • The applicant’s passport, birth certificate, and a letter from the authority supporting the adoption. Certified copies of adoption papers showing that a legal fully fledged and permanent adoption has taken place which will include evidence that the 11th authority permits the child to migrate to Australia.
  • If the adoption happened in an expatriate manner then a written statement outlining the reasons for the adoptive parents residence overseas as well as the evidence to support this will be needed.
  • You will need to provide evidence that you have a suitable accommodation for the child.

Application Process

Before applying

If the child was adopted through an expatriate adoption process, you will need to give evidence that:

  • At least one of the adoptive parents decided outside Australia for more than 12 months immediately before lodging the visa application
  • Adoptive parents did not arrange to reside overseas, so they could avoid Australia’s inter-country adoption laws
  • Adoptive parent will have full length permanent parental rights with no remaining legal ties between the child and the birth parents
  • The child was adopted in line with the adoption laws of the home country.

For children above 16 years of age, you will need a police certificate to support their good character .

Visa application

You will have to apply for this visa on paper. You need to complete the relevant forms together by post with correct prepaid postage to the child and other family processing centre in Perth.

After applying

The department will let the applicant know after receiving the application and the documents. The department will convey the visa outcome in writing.

Adoption Visa Processing Time

Ensure that you fill your application form correctly and Include all the documentation and information in it. If this is not so, then your visa may take a longer time to process. The department will also take some time to verify the information provided by you. Make sure that you pay the full visa application charge or else the department will return your application.
